  1. Acceptance of terms

By requesting a quote, booking a move, or using any service provided by Home Town Moving LLC ("Home Town Moving," "we," "us," or "our"), you ("Customer," "you," or "your") agree to be bound by these Terms & Conditions ("Terms").

If you do not agree to these Terms, please do not proceed with booking our services. These Terms apply to all moving services, consultations, and website use associated with Home Town Moving LLC.

These Terms form the entire agreement between you and Home Town Moving regarding the services described herein and supersede any prior oral or written understandings.

  1. Service Description

Home Town Moving LLC is a local moving coordination company headquartered in Alpharetta, Georgia. We provide residential moving, commercial moving, and specialty item moving services within the greater Atlanta metro area, with a primary focus on the Alpharetta and Roswell communities.

Services Include:

  • Residential Moving: Home-to-home moving services for households of all sizes, including apartments, condos, and single-family homes.

  • Commercial Moving: Office and business relocations, including furniture, equipment, and fixtures.

  • Specialty Moving: Coordination and handling of high-value, oversized, or fragile items including pianos, gun safes, marble furniture, and antiques. Specialty services may be fulfilled in coordination with trusted third-party specialist partners.

Services are subject to availability and geographic scope. Home Town Moving reserves the right to decline any move request at its sole discretion.

  1. Booking & Estimates

All estimates provided by Home Town Moving are based on information supplied by the Customer at the time of inquiry. Estimates are not guaranteed final prices and are subject to change based on actual conditions at the time of the move, including but not limited to:

  • Volume of items differing from what was disclosed

  • Access difficulties (stairs, elevators, narrow hallways, distance from truck to entrance)

  • Additional items requested on moving day

  • Unanticipated specialty handling requirements

  • Extended time beyond the estimated duration

A booking is confirmed only upon receipt of written or verbal confirmation from Home Town Moving. We recommend customers confirm all bookings at least 48 hours prior to the scheduled move date.

Customers are responsible for ensuring all information provided during the booking process is accurate and complete. Inaccurate information that affects the scope or complexity of a move may result in adjusted pricing.

  1. Payment Terms

Home Town Moving accepts payment by cash or credit/debit card. Payment is due upon completion of services unless otherwise agreed in writing prior to the move.

Payment Conditions:

  • Final payment is based on actual services rendered, which may differ from the initial estimate.

  • Any additional charges incurred during the move (additional time, items, or access difficulties) will be communicated to the Customer and added to the final invoice.

  • A deposit may be required for large or complex moves, as determined by Home Town Moving at the time of booking.

  • Returned or declined payments are subject to a $35 processing fee.

  • Balances unpaid for more than 30 days may be subject to a late fee of 1.5% per month and referred to collections.

Home Town Moving does not store credit card information beyond what is needed to process a single transaction.

5. CANCELLATIONS & RESCHEDULING

OUR CANCELLATION POLICY: Home Town Moving understands that moving plans can change. We ask for reasonable advance notice and handle all cancellations on a case-by-case basis in good faith.

Standard Policy:

  • 48+ hours notice: Cancellation or rescheduling at no charge.

  • 24–48 hours notice: A cancellation fee of up to 25% of the estimated job cost may apply to cover crew scheduling costs.

  • Less than 24 hours notice: A cancellation fee of up to 50% of the estimated job cost may apply.

  • Same-day or no-show cancellations: Subject to a fee up to the full estimated cost of the move.

Discretionary Exceptions:

Home Town Moving LLC reserves the right to waive or modify cancellation fees at our sole discretion based on circumstances, relationship history, and goodwill. We are a community-first company and will always aim to work with customers fairly. However, this flexibility does not constitute a waiver of our right to enforce this policy in the future.

Weather & Force Majeure:

In the event of extreme weather, natural disaster, or other circumstances beyond either party's control, Home Town Moving will work with Customers to reschedule at no penalty. If rescheduling is not possible, deposits will be refunded at our discretion.

  1. Customer Responsibilities

To ensure a safe and efficient move, Customers agree to:

  • Disclose all items to be moved, including any heavy, fragile, or specialty items, prior to the scheduled move date.

  • Ensure items are reasonably prepared for transport (e.g., drawers emptied of heavy items, loose items boxed or secured).

  • Ensure adequate access to both origin and destination locations, including clear pathways, available parking, and elevator reservations where applicable.

  • Be present or have a responsible adult authorized to make decisions present at both the origin and destination locations.

  • Not request that movers transport items that are prohibited under Section 8 of these Terms.

  • Notify Home Town Moving of any known fragile, high-value, or irreplaceable items prior to the move so appropriate care and coordination can be arranged.

Home Town Moving is not responsible for damage to items that were not disclosed, improperly prepared, or that the Customer declined to declare prior to the move.

  1. Liability & Claims

Home Town Moving takes care with every item we handle. In the event that an item is damaged or lost during a move, the following process applies:

Reporting Damage:

  • All claims for damage or loss must be reported in writing to info@hometownmoving.com within 3 business days of the move completion date.

  • Claims submitted after this period may not be honored.

  • Customers should document any visible damage at the time of delivery by noting it on the moving receipt or bill of lading.

Valuation & Liability Limits:

Unless otherwise agreed upon in writing prior to the move, Home Town Moving's liability for damaged or lost items is limited to the lesser of:

  • The actual repair or replacement cost of the item; or the minimum liability amount as required under applicable Georgia law.

Customers who require full replacement value coverage for high-value items are encouraged to arrange third-party moving insurance prior to their move date. Home Town Moving does not provide full-value protection insurance.

Exclusions:

Home Town Moving is not liable for damage resulting from:

  • Items packed by the Customer

  • Pre-existing damage not disclosed prior to the move

  • Items of extraordinary value not declared in advance (jewelry, artwork, collectibles, electronics)

  • Acts of God, weather events, or other circumstances beyond our control

  • Customer refusal to allow proper packaging or handling techniques

  1. Prohibited Items

For the safety of our crew, other customers, and property, Home Town Moving will not transport the following items:

  • Hazardous materials, including flammable liquids, propane tanks, gasoline, paint, or chemicals

  • Explosives, ammunition, or firearms (unless pre-arranged and legally compliant)

  • Perishable food items or open food containers

  • Live plants (may be accepted at crew's discretion for short local moves)

  • Live animals or pets

  • Illegal substances or contraband

  • Items exceeding safe transport limits without prior specialty arrangement

Violation of this policy may result in immediate termination of services without refund and may be reported to appropriate authorities where required by law.

  1. Third-Party & specialty Partners

For certain specialty moving services — including pianos, gun safes, marble furniture, antiques, and other high-value or technically complex items — Home Town Moving may coordinate with trusted third-party specialist partners to perform or assist with the move.

When third-party partners are involved:

  • Home Town Moving will disclose such arrangements to the Customer in advance where reasonably practical.

  • Third-party partners are vetted and trusted by Home Town Moving, but operate as independent entities.

  • Home Town Moving acts as the coordinating party and primary point of contact for the Customer.

  • Liability for services performed by third-party partners is governed by those partners' respective terms and insurance coverage, which may differ from Home Town Moving's standard policy.

The use of a partner does not alter your agreement with Home Town Moving as your service provider of record.

  1. . Intellectual Property

All content on the Home Town Moving website — including text, graphics, logos, illustrations, and branding — is the property of Home Town Moving LLC and is protected by applicable intellectual property laws.

You may not reproduce, distribute, or use any Home Town Moving content without prior written permission. Unauthorized use of our brand, name, or materials may result in legal action.

  1. . Disclaimers of Warranties

HOME TOWN MOVING PROVIDES SERVICES "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that our services will be error-free, uninterrupted, or that results will meet your specific expectations. Service timelines and outcomes depend on variables outside our full control, including weather, traffic, building access, and the nature of items being moved.

  1. . Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, Home Town Moving LLC, its owners, officers, employees, and agents shall not be liable for any indirect, incidental, special, punitive, or consequential damages arising from or related to our services or these Terms, including but not limited to:

  • Loss of use, income, or profits

  • Emotional distress or inconvenience

  • Delays caused by traffic, weather, or other factors outside our control

  • Damage to items not properly disclosed or prepared

In no event shall Home Town Moving's total liability to any Customer exceed the total amount paid by that Customer for the specific move giving rise to the claim.

13. Indemnification

You agree to defend, indemnify, and hold harmless Home Town Moving LLC and its owners, employees, and agents from and against any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising out of or in any way connected with:

  • Your use of our services

  • Your violation of these Terms

  • Your provision of inaccurate or incomplete information

  • Your violation of any applicable law or the rights of a third party

  1. Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict of law provisions.

Any dispute arising from these Terms or the use of Home Town Moving's services shall first be attempted to be resolved through good-faith negotiation between the parties. If resolution cannot be reached within 30 days, disputes shall be submitted to binding arbitration in Fulton County, Georgia, under the rules of the American Arbitration Association, unless both parties agree otherwise in writing.

Nothing in this section prevents either party from seeking emergency injunctive or other equitable relief in a court of competent jurisdiction where necessary to prevent irreparable harm.

  1. Changes to These terms

Home Town Moving LLC reserves the right to update or modify these Terms at any time. Updated Terms will be posted to hometownmoving.com/terms-and-conditions with a revised "Last Updated" date at the top of the page.

Continued use of our services following any such changes constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.

For bookings already in progress at the time of a material change, the Terms in effect at the time of booking shall apply.
